Since 1998 Queensland legislation has allowed for appointments of Powers of Attorney which ‘endure’ past the time when a person loses the capacity to make their own decisions, and which can cover ‘lifestyle’ decisions as well as financial decisions. A much better system than the decision-making vacuum it replaced, but a system certainly not immune from abuse. Presented by Suncoast Community Legal Service, this presentation by Mahoney Neuwirth from Butler McDermott will describe the process, run you through the options available when appointing an Enduring Power of Attorney and suggest ways to help safeguard yourself against potential abuse by attorneys.
