De Belin: ‘It wasn’t rape, she enjoyed it’
The woman who accused Jack de Belin of rape "winked and smiled" when the NRL player suggested she join him and his friend for sex, he has told a court.
De Belin gave detailed evidence of the sexual encounter as he was questioned in court on Thursday about the night he and co-accused Callan Sinclair allegedly raped the 19-year-old woman in a Wollongong unit in 2018.
The St George Illawarra forward and Sinclair have pleaded not guilty to five counts of sexually assaulting the woman, saying group sex with her was consensual.
De Belin told the District Court in Wollongong: "She was moaning … muttering yes."
In cross-examination, crown prosecutor David Scully SC asked de Belin whether the woman had any control over the threesome as the men swapped positions.
"We all had a say in it," de Belin replied.
He said she was "enjoying it, she was moaning, just like a normal sexual interaction".
De Belin told the court he had a conversation with Sinclair at Mr Crown nightclub where he met the woman.
"I said words to something along the lines, 'I think we're on here'," he said.
He said he then asked the woman, "Me, you and Cal?".
De Belin told the court the woman responded, "You have a girlfriend", to which de Belin replied, "I can keep a secret if you can". He said the woman "winked and smiled''.
"She was just very attention-seeking. Her dancing was dramatic and over the top," he told the court.
De Belin said he was dancing upstairs with Sinclair and friends Matt Clune and Jai Field when he first saw her.
"I seen her give Matt Clune a cuddle," he told the court.
"When she gave you a cuddle did you say or do anything?" his barrister David Campbell SC asked.
De Belin replied: "I said something along the lines of: 'Aren't you a little cutie.' She just giggled back."
He said the woman gestured towards him and Sinclair with her fingers in a V shape and her tongue out at the nightclub. He told Mr Campbell he interpreted that to mean oral sex.
CCTV footage has been played to the court of the woman gesturing this, but it does not show who she was gesturing towards.
De Belin said the woman agreed to go back to the unit. On the drive there, de Belin said, they were talking about sex and the pair "complimented (her) on her breasts".
Mr Scully put to de Belin that he had planned to have a threesome that night and he had not asked the woman if she consented.
De Belin said he had not planned it and he had asked her.
